简论警察开枪预警之法律程序

目前,针对警察枪支使用程序的讨论多集中于开枪的法定情形设定层面。警察枪支使用需要一个综合、立体、全方位的法律体系进行调整,开枪前的预警程序是该法律体系中至关重要的一环,而有关这方面的研究却十分薄弱和欠缺。笔者将从警察开枪预警可能涉及的环节入手,逐一阐述个中潜在法律问题,并结合国内外相关立法实践,力图构建适合我国法律土壤的警察开枪预警法律程序。

Legal Process for the Police to Fire Warning Shot

The current discussions about the process for the police to use firearms are mainly focused on how to work out legal situations.The use of police firearms needs adjustment in an integrated,three-dimensional and comprehensive way.The warning process before firing the shot is the key point in the legal process.We actually lack research on the issue in question.Proceeding from the warning process before firing the shot and combining legislative practices home and abroad,the author explores potential legal issues,aiming to designing a legal process suitable in China for the police to fire warning shots.
