知识产权滥用导致的两类垄断行为方式分析

随着知识产权进入贸易领域,知识产权滥用所导致的垄断行为日益严重,在知识产权领域惩治垄断行为,维护市场竞争秩序已经成为世界多数国家反垄断法律制度和世界贸易组织相关法律规范的重要内容。本文采取比较研究和例证分析研究等方法对知识产权滥用所导致的滥用市场支配地位和联合限制竞争两类垄断行为的表现方式进行了分析,以期对我国反垄断立法和法学理论研究有所裨益。

Analysis on the Two Monopoly Actions Caused by Abuse of IPRs

As IPRs entering the area of trade, monopoly caused by abusing IPRs is becoming more severe than before.Punishing monopoly actions in the field of IPRs and maintaining the competition orders of markets have become important content in the most countries' legal system of antimonopoly law and corresponding regulations of WTO. The paper analyzes showing form of abusing the dominance of market caused by abusing IPRs and the collusive restriction on competition with the way of comparative study and analysis study in order to benefit both the legislation of Chinese antimonopoly law and law research.
