| 摘 要： | 现行刑法关于“国家工作人员”的规定仍不完善，主要体现在不能清晰地界定国家工作人员的范围，执法中引发诸多争议。尽管全国人大常委会和高检、高法颁布了很多立法、司法解释，仍不能解决立法上存在的问题。究其原因，现行刑法对“国家工作人员”立法标准上的不统一，导致了执法中产生分歧。笔者建议，国家工作人员的范围应以“职责论”重新界定。
