| 摘 要： | 从世界各国的宪政实践来看,违宪审查主要分为三种模式:代议机关审查模式、普通法院审查模式和专门机关审查模式,而每种模式又都根源于各国制度形成的社会和历史背景。本文意在对各主要模式进行梳理的基础上,指出违宪审查制度之于我国法治和宪政建设的重要意义,以期促进我国的法治进程。

| Abstract: | According to the practice of various countries' constitutionalism, the judicial review system of unconstitutionality is mainly divided into three kinds of modes: the mode of the parliamentary institution's review, of the ordinary court's review and the special organ's review, while each kind of mode can trace back to the social and historical background of each country. On the basis of arranging the different modes, this article intends to point out the profound meaning of this system over our country's constitution construction and system of government by law so as to promote the advancement of our country's government by law. |
