绝对新颖性在我国适用的困境及对策

摘    要:我国将专利授权条件中“混合新颖性”标准改为“绝对新颖性”标准引起了广泛关注。文章首先通过分析绝对新颖性标准与其他新颖性标准的区别,明确绝对新颖性标准的概念;再结合具体国情、专利申请状况以及企业发展实际等因素进行分析,指出采用绝对新颖性标准是有利于促进创新、符合国情和保护民族企业发展的;最后从创造良好法律环境、重视专利工作和新型知识产权人才培养、创建有效技术转换机制三方面对我国适用绝对新颖性标准提出了解决对策。

Abstract:The development of novelty standard of granting patent fight from the "mixed novelty" standard to "absolute novelty" standard is an important part of the third revision of the Patent Law. This development has aroused wide attention and heated debate. Firstly, the differences between absolute novelty standard and other novelty standards could be discovered through the analysis of the concept of absolute novelty standard. Secondly, from analyzing the specific conditions of our country, the patent application status and the development situation of industry, it is found that the implement of absolute novelty standard in the patent Law lines with national conditions, promotes innovation and protects national industrial development. Finally, there is a suggestion on the countermeasure-solution of the implementation of the absolute novelty standard: create a favorable legal environment, pay more attention to patent work and the training of new personnel in intellectual property and create an effective mechanism for tech- nology application.
