Duguit's Contribution to Reconstruction of Modern Public Law Theories: From Sovereignty to Public Service

Duguit put forward an important doctrine of modern public law:the modern state's function has changed or should change from sovereign government to public service.Duguit analyzed elaborately the presuppositions and phenomena of the change,discussed its profound impact on the system of public law,especially on the administrative agencies,administrative acts and actions against administrative agencies.However,since Duguit himself was closed in modernity thoughts,samble that his reconstruction idea cannot benefit us without criticism.
