| 摘 要： | 《中华人民共和国企业破产法》已于2007年6月1日起施行,新破产法在创设了许多新制度(如管理人制度)的同时,也再次明确了金融机构可以破产这一命题,并在附则里作出规定。新破产法授权国务院制定相应的金融机构破产实施条例。本文就金融机构破产的法律问题展开论述,以期对金融机构破产的理论实践有所帮助。
