后金融危机时代信用评级机构法律责任之完善

信用评级机构在市场经济过程中扮演着重要的角色,它在对市场进行导向、促进被评级对象发展、活跃市场经济等等方面有着不可替代的作用。然而,在这次金融危机之中,信用评级机构不仅没起到任何作用,反而对金融危机推波助澜,充分暴露出信用评级机构的诸多问题。其中最重要的一个问题是难以追究信用评级机构的法律责任,所以完善信用评级机构的法律事责任应是讨论的重点。

On Improvement about the Legal Liability for Credit Rating Agencies Subsequent to Financial Crisis

In the market economy,credit rating agencies plays an important and irreplaceable role,such as guiding the market,promoting the rated object developing,activing market economy.However,in this financial crisis,credit rating agencies did not play any role,but helped fully exposed the many problems.One of the most important problems is difficult to investigate the credit rating agencies legal responsibility.The focus of this paper is to perfect the credit rating agencies legal liability.
