浅析刑事辨认中的问题与对策

刑事辨认是侦查实践中经常使用的一种侦查行为。刑事诉讼法修正案已明确赋予辨认笔录以法定证据地位,然而我国刑事诉讼法却没有规定辨认制度,现有的相关规定简陋粗疏,无法对侦查实践进行指导与约束。在司法实践中,刑事辨认亦存在着侦查人员操作混乱的问题。要解决这些问题,必须从完善辨认制度的程序规则和排除侦查人员非法获取的辨认结论两个方面着手。

Analysis of Issues and Countermeasures in Criminal Identification

The criminal identification is a kind of detection behavior frequently used in practice.The legal status of the transcripts of criminal identification has been guaranteed in the Amendment of the Code of Criminal Procedure clearly.However,the Code of Criminal Procedure does not have any provisions concerning the identification system.The existing relevant provisions are not accurate enough to comprehensively guide and constrain investigative practice.While the investigators don’t comply with the identification rules,the chaos in the legal practice also exists.To solve these problems,we should improve the system of identification rules and exclude the transcripts of criminal identification that obtained through illegal means.
