Practical Thinking of Administrative Detention against the Sentence

Prison term offsetting is just a little part of the criminal laws system;however,it has much juridical practice meaning in terms of those important matters such as freedom of person,impartial enforcement of law and the protection of legal rights.Of those the most common but controversial is the discussion of administrative detention of restricting people’s freedom and offsetting of prison term offsetting.Take the drug-related crimes as an example,recently the theory policy and accounting practice are different.Based on the abiding by the recent regulations,we should reflect the reason of the controversy,and pay more attention to the law-enforcing supervision through the system perfection and adjusting practice,in order to realize the balance purpose and fair value of prison term offsetting,and push the criminal law become a law of rights protection and power restriction.
