| 摘 要： | 案例二一于《奏谳书》22个案例中相当独特,该案例与两个"东周案例"同为一类。通过与放马滩秦简《志怪故事》的类比,该案例文本的秦汉文书传统具有与文学艺术创作相结合的特征。这个案例文本包含的法律、文书和文学等诸多内涵,尚有待于进一步研究的发掘。

| Abstract: | The 21th legal case of the Zouyanshu is regarded as a spercial one.The 21th case is the same kind of case with so-called two East Zhou cases.Compared with a Qin Dynasty’s written text called Ghost Story uncovered in Fangmantan,the 21th case’s text shows the combination between the bureaucratic paperwork tradition of the Qin and Han Dynasties and the literary creation.The legal meaning and literary meaning of the case is necessary to be investigated by further reserch. |
