不可扩散信息保护问题初探

信息的有效扩散是促进社会发展与进步的因素之一,然而,信息的有效扩散除强调高效的扩散机制与扩散模型外,也应强调信息在扩散中应遵守的法律规则或制度约束。在充分考虑法律和相关制度在信息扩散过程中所提出的约束性要求的基础上,提出了"不可扩散信息"的命题,在对不可扩散信息的概念、特征、分类,以及不可扩散信息保护的必要性等进行充分论述的基础上,针对不同种类的不可扩散信息提出了在其保护过程中应特别关注的问题。

Preliminary Analysis on the Protection of Nonproliferation Information

The effective information proliferation is one of the factors to promote the development and progress of the society.If we want to proliferate the information effectively,we should emphasize the importance of legal and institutional constraints of the information diffusion in addition to emphasizing efficient proliferation mechanism and proliferation model.In adequate consideration of legal and institutional constraints in the information proliferation process,this paper puts forward "nonproliferation information" proposition.Based on adequate discussion of the concept,characteristics,classification of the "nonproliferation information" and the protection necessity of nonproliferation information,this paper point out the most important issues of the protection of divers nonproliferation information.
