共同犯罪若干问题研究

共同犯罪中“利用”式犯罪是司法实践中经常遇到的一类案件,这类案件具体包括三种类型:一种是“单纯”利用式犯罪,即对他人的前行为持肯定态度,但其与他人无意思联络,仅仅是“单纯”利用他人的先前行为产生的效果或者影响作为自己犯罪的有力工具;另一种是“复杂”利用式犯罪,即与前行为人形成意思联络介入到犯罪中,利用前行为的效果或影响单独或者与他人共同实施犯罪;第三种是在被利用人始终知情的情况下,利用人利用被利用人的行为实施犯罪,但二人又无意思联络.

Study on Several Issues in Common Crime
