| 摘 要： | 通过我国《物权法》对占有保护制度的规定,可以看出我国占有保护制度的设立,反映了经济需求,适应了社会发展,具有重大的实际意义。但同时也存在一些问题,在此对我国《物权法》的构建和完善提几点建议:即在我国的法制理念和国情条件之下,是否应该规定自力救济权;而我国占有保护请求权的规定又是否合理,是否有需要进一步完善的地方;我国有没有必要把占有之诉单独列出;以及论述一下我国侵害占有的损害赔偿的保护范围。

| Abstract: | Trough our property law on the systems of possession protection rules,we can see that China’s possession protection system,which reflected the economic demand,adapt to the social development,has great practical significance.But there are some problems too: under our legal system idea and national conditions,should or not stipulate self-relief right;and whether our claim of possession protection provisions reasonable,whether there is a need to list the lawsuit of possession separately. |
