德国现行刑法典与判例对法人犯罪皆持否定态度 ,但学术界对法人有害行为追究刑事责任的观念也已得到广泛承认。本文通过探讨德国法律制度对法人处罚规定的得失 ,指出法人犯罪肯定论虽然日益受到重视 ,但在和刑法理论的调和上还有许多不完善之处。应在从正面肯定法人的犯罪能力的基础上 ,探讨合适有效的制裁体系

Review on German Legal Person Criminal Responsibility

Both the contemporary German criminal law and cases hold a negative attitude to the legal person crime,but at the same time the view of punishing the harmful action of legal person is widely accepted.Through studying the merits and defects of the German laws on punishing the legal person,this article points out that although the theory of admitting legal person crime is gaining more and more support,it still has many defects that are not consistent with the criminal law theory.On the basis of admitting the criminal ability of legal person,suitable and effecient punishment system should be sought.
