论学生伤害事故赔偿制度存在的困境和出路

学生伤害事故是指在学校实施的教育教学活动或者学校组织的校外活动中,以及在学校负有管理责任的校舍、场地、其他教育教学设施、生活设施内发生的,造成在校学生人身损害后果的事故。学校应当依据过错主义原则对这种事故承担赔偿责任。但问题的焦点在于学校赔偿经费的无源,因为学校是公益性组织,无营利目的。因此,我们有必要分析研究解决赔偿困境的出路,即主张走责任保险之路,将侵权行为法与保险法结合起来,并由此提出立法建议。

The Jam and Countermeasures of Compensation System on Being-injured-student Accidents

Being-injured-student accidents mean the accidents cause the undergraduate's bodies and health injured in the teaching and educating activities in or out school or in the campus,playground,other education facilities,living establishments managed by school.School shall take compensable responsibility for these accidents according to offense principle.While the key is that school has no resource of compensable fund,because school is a kind of commonweal organization whose goal does not mean interests.Thus,it needs us to analyze and study the way to settle the compensation problem that is liability insurance.Through this way we can combine the infringement law and insurance law to research the detail problems further.
