西部区域生态环境法治建设的现状与未来——兼论我国环境立法的完善

西部区域生态环境对中国经济社会的发展有着全局性的重要意义。从地缘法律文化和国家立法的双重视角考察,西部区域生态环境法治建设面临的主要障碍因素是西部社会主体对法律的需求不足,国家环境立法尚不能完全适应西部地区经济社会发展的需要。为此,需要在可持续发展的旗帜下,全面重构我国环境立法,并着重解决好西部地区性差异对环境法律的特殊需求,充分关注西部环境习惯法文化的合理价值。

Status and Future of the Legal Construction of Ecological Environment in Western Regions——On the Perfection of Environmental Legislation in China

Ecological environment in western regions is crucial for the development of economy and society.At present,one major factor obstacling the bio-environment legality construction in the west is that people have not paid enough attention to the law,and that the environment legislation has not fully met the need of western economic and social development.Therefore,in accordance with the strategy of the sustainable development,we need restructure the national environment legislation;specially solve the problems such as the regional difference of the west to the need of the environment law,and pay more attention to the reasonable value of environmental conventional law culture in western regions.
