| 摘 要： | 财产申报制度是基于"官员隐私权受限"的理念并建立在"性恶论"的假设之上的.将财产申报制度上升到法律层面,对于腐败的预防与惩罚、公职人员的自我保护极为必要.在我国,财产申报制度的法制化尚需要调和观念上的冲突,走出认识上的误区,并借助严谨、协调的立法方能实现.

| Abstract: | Based on the notion of "limited privacy of the officials" and established under the hypothesis of "theory of original evil of human nature",the property report system should be upgraded to legal level.The legalization of the property report system is propitious to the prevent ion and punishment of the corruption and self protection of the public functionary;therefore the ideaistic conflict should be moderated and cognitive mistake should be eradicated in order to realize the system by virtue of precise and harmonious legislation. |
