《突发事件应对法》面临的新挑战与修改着力点

2007年制定的《突发事件应对法》作为我国应急管理基本法,其运行实效在此次新冠肺炎疫情应对中受到集中检验与冲击,并面临一系列新形势新要求的挑战,引人关注。从我国应对突发事件和修订《突发事件应对法》的需要出发,有必要对该法修改的关键问题进行聚焦并深入探讨。此次世纪疫情对《突发事件应对法》的挑战主要在于冲击了立法理念中的底线思维不足问题、凸显了制度架构中的统筹性和综合协调性不足症结以及放大了法律实施中的实效性不足弊端等三个方面。应当抓住《突发事件应对法》修改契机,针对此次新冠肺炎疫情应对暴露出的突出问题,聚焦理念提升、体制与机制优化,堵漏洞、填空白、补短板、强弱项,完善相关法律制度,为迎接未来可能出现的问题提供制度准备,积极发挥制度增强人类行动的预期性功能。

The New Challenge and Focuses of Amendment of the Emergency Response Law

The Emergency Response Law enacted in 2007 is the basic law of emergency management in China.Its operational effectiveness have been intensively tested and impacted in the response to COVID-19 pandemic,and faced with a series of challenges from new situations and new demands.Starting from the need of responding to emergencies and revising the Emergency Response Law,it is necessary to focus on and discuss in depth the key issues of the revision of the law.The challenges of this epidemic to the Emergency Response Law mainly lie in three aspects:impacting on the bottom line thinking in the legislative concept,highlighting the lack of coordination and integration in the institutional framework,and amplifying the shortcomings of insufficient effectiveness in the implementation of the law.We should grasp the opportunity of revising the Emergency Response Law,aiming at the problems exposed in the response to COVID-19 pandemic,focusing on upgrading the concept and optimizing the system and mechanism,to close legal loopholes,fill in the blank area of law,tackle areas of weaknesses,and perfect relevant legal system,providing institutional preparation for meeting possible problems in the future,and actively exerting the system to enhance the expected function of human actions.
