招安“民间刑事悬赏”，整合刑事悬赏制度

在我国,刑事悬赏制度虽然已经有法可依,但存在单一化启动的缺陷,实质上是"依职权式刑事悬赏";公民个人刊登悬赏通告缉拿凶犯,即"民间刑事悬赏",是新近出现的现象,它具有双重属性,需要建立合理的配套制度方能发挥其优良的效用.把握两者的结合点,融合"民间刑事悬赏"与"依职权式刑事悬赏",建立具有"依职权"和"依申请"二元启动模式的刑事悬赏制度,应当是我国刑事悬赏制度改革的方向.

"Nongovernmental Criminal Offer of a Reward" and Conforming the System of Criminal Offer of a Reward

In our country, although the system of criminal offer of a reward has laws to go by, there's still the defect of simplified starting. Essentially, this system is " criminal offer of a reward according to authority ". Recently, a phenomenon appears that some individual citizens publish to offer a reward for seizing criminals, which is called " nongovernmental criminal offer of a reward ". This kind of act has dual properties, and it needs reasonable supplemental systems to bring its effectiveness into full play. This paper points out, the systematic reform of criminal offer of a reward should be made by combining the " nongovernmental criminal offer of a reward " with " criminal offer of a reward according to authority ", and establishing a binary starting pattern of this system, namely, " according to authority " and " according to application".
