| 摘 要： | <消费者权益保护法>第49条确定了惩罚性赔偿责任制度,该责任在性质上不是传统私法上的责任,而是兼具有公法和私法性质的经济法上的责任.但该惩罚性赔偿责任制度在适用过程中存在诸多争议问题,需要进一步确定与完善.
