| 摘 要： | 为适应职务犯罪发展的新趋势,在职务犯罪侦查中适用技术侦查措施已是势在必行,有其正当性、必要性和可行性.但技术侦查措施的适用也易造成对公民基本权利的侵害,因此应根据技术侦查措施的自身特点,在立法中明确规定适用的范围、对象、条件、司法审查等,以实现打击犯罪与保障人权的相对平衡.
