在法律之内寻求社会效果

从逻辑上说,社会效果既可以通过法律获得,也可以在法律之外获得,但在司法中寻求社会效果应当主要通过法律或法律之内实现;只有在特殊情况下,并在严格的规则和程序导向下,才可以"变通适用法律"。事实上,在法律之内存在着满足社会效果实现的巨大空间,只要本着良知,充分、正确地运用多种可行的方法,就可以将社会效果最大化,当然,这要具备一定的条件。

Looking for Social Effects within Law

Logically speaking,social effects can be materialized either through law or through other methods,but in the context of justice they must be pursued mainly through law or within law.Only in very special condition and oriented by strict rules and procedures law can be changed to accommodate such special condition.In fact,there is a great space to satisfy the materialization of social effects within law and under certain prerequisites social effects can be optimized.
