论刑事诉讼证明中的责任区分

刑事诉讼证明具有复杂的结构 ,存在多主体、多层次。因而 ,其证明责任也应是严格加以区分的 ,可分为 :其他诉讼参与人的说明责任 ;当事人的举证责任 ;公安司法机关的证明责任。在明确了刑事诉讼所有参与主体在证明活动中的责任的基础上 ,构造出完整的刑事诉讼证明中的责任区分理论

On Division of Burden in the Proof of Criminal Action

With The characteristics of multi subject and multi level,the proof in crminal proceedings has been complicatedly structured.The burden of proof should therefore be strictly differentiated.It is suggested that the burden of proof could be classifide into three different categories,namely,the burden of elucidation placed upon other participants in criminal proceedings,the burden of producing evidences rested on the two parties,and the burden of authentication borne by the judicial organs.This article is dedicated to construct a comprehensive theory about the classification of the burden of proof after making clear their different roles of all the participants in criminal proceedings in the process of proof.
