| 摘 要： | 为了维护正常的金融秩序,保护金融机构和公众的合法利益,《中华人民共和国刑法修正案(五)》从源头上对信用卡犯罪作了较全面的立法完善,增设了妨害信用卡管理罪。在司法实践中,要准确认定妨害信用卡管理罪,必须对妨害信用卡管理罪的客观方面予以认真的、深入的剖析,全面地理解和把握其所包含的意义。

| Abstract: | To keep order in the financial world and safeguard the legal rights of financial institutions and the public,the 5th Bill of Amendment to the Criminal Law in People's Republic of China improves the legislation of the crime by taking advantage of credit cards and the crime impairing the management of credit cards has been added.In the judicial practice,the clear determination of the crime impairing the management of credit cards should be based on the comprehensive understanding of this crime such as the spirit,background and goal of the legislation as well as the contents of this crime. |
