论行政连带责任

我国已有的行政法规范如2003年5月7日国务院发布的《突发公共卫生事件应急条例》,在多处规定了行政连带责任问题,然而,行政连带责任在行政法学理论中却显得较为单薄,要建立理性化的行政连带责任制度,必须对有关的重大理论问题予以澄清。因此有必要对行政连带责任的构成、责任类型、法律调控等重大问题进行系统探讨。

On Joint Administrative Liability

Joint administrative liability has been prescribed by existed administrative regulations of our country such as Emergency Regulation on Abrupt Events of Public Hygiene issued by the State Council on May 7 in 2003. However, the theory of administrative jurisprudence about joint administrative liability is insubstantial. In order to establish reasonable system of joint administrative liability, related important theoretic problems must be clarified. Therefore we make a systematic discussion on important problems such as composition, types and legal control of joint administrative liability.
