摘    要:小产权房是在土地所有权的国家、集体的二元分割体制下,地方政府与农村集体在农村土地增值的分享过程的必然产物,在地方政府的“土地财政”政策和目前法制环境的刺激下,小产权房成为折射的社会矛盾和利益冲突的焦点。

Abstract:Houses with limited property rights are the outcomes of the sharing of land - added value between local government and rural collectives in the system with land owned either by the State or Collectives. Such houses have been the focuses of social conflicts and the conflicts of respective interests.
