| 摘 要： | 附带民事诉讼中的民事赔偿,历来是理论界和实务部门所关注的焦点之一。杭州胡斌案、成都孙伟铭案和近来闹得沸沸扬扬的李刚之子案,再次把人们的视线引向了附带民事诉讼中的民事赔偿。附带民事诉讼中的民事赔偿应当包括精神损害赔偿,附带民事诉讼中民事赔偿的＂赔钱减刑＂则应当慎用。

| Abstract: | The compensation in accessory civil actions has been always one of the focuses both in theoretical circle and practical departments.The ＂Hang Zhou Hubin Case＂,＂Chengdu Sun Weiming Case＂ and the recent notorious ＂Son of Li Gang Case＂ drew again our attestation to the compensation in accessory civil actions.The compensation in accessory civil actions should include compensation for mental injury,while great caution should be taken against adoption of ＂Compensation-for-commutation＂. |
