我国侦查辨认程序规范化研究初探

随着诉讼法治文明的不断推进,侦查辨认程序的规范化研究越来越受到理论界和实务部门的广泛关注。我国对侦查辨认程序的研究无论是距离法治化的要求还是从指导实践的需要方面都具有明显的＂滞后性＂。因此,我国侦查辨认应在考虑程序立法和司法现状的基础上,从法治文明和侦查实效双重视角来探讨侦查辨认程序的完善措施。

A Tentative Analysis on Procedure Standardization of Investigative Identification in China

With the continuous litigation development,the research on standardization of investigative identification procedures draws more and more attention from theoretical circles and practical departments.In our country,this research still lags behind other countries in terms of the requirements both of the rules of law and the guidance to practice.Hence,measures for perfection should be identified from the double perspectives of judicial civilization and investigative effectiveness,and on the basis of procedure legislation and present judicial status.
