| 摘 要： | 将军职罪纳入刑法典的做法,宏观上无视军民分治的社会事实及军事刑法的价值取向,微观上会带来一系列立法技术上的问题。为了落实军事专业主义的要求,迎合世界范围内军职罪立法的潮流,更好地展开军职罪的立法内容,在不影响刑法典内容完整的前提下,军职罪宜采取单独立法的模式。
