论我国的违宪审查体制与完善

本文立足于中国实际 ,在比较衡平了国外三种违宪审查类型的利弊后 ,认为我国实行以全国人大及其常委会为主的违宪审查制度较为适宜。文章还讨论了我国现行违宪审查制度的审查主体、审查范围及审查方式 ,并从设立专门工作机构和扩大全国人大常委会审查范围两方面提出了完善的建议。

Perfecting Review System of the Constitutionality in China

The thesis, having made a comparative study of and measured the merits and demerits of the three types of review systems of the constitutionality in foreign countries, believes that it is appropriate for China to practice the review system of the constitutionality immediately under the leadership of the National People's Congress and its Standing Committee. The thesis also copes with the review subject, review jurisdiction, and how to review the constitutionality at present social condition with some proposals on the establishment of peculiar departments and extension of the review range.
