论监狱执法文书的规范化——以提请减刑建议书为例

如何制作规范的提请减刑建议文书是每个监狱遇到的实际问题之一。近年来,随着刑法、刑事诉讼法的相继修订,提请减刑建议文书的制作模板却未及时修改,各地监狱只能参照原有规定,因此文书制作格式差别较大。规范的提请减刑建议文书模板应以新修订的法律、法规为基础,结合监狱工作的实际需要以及提请减刑建议程序的特点,如此,才能使文书模板更加规范、合理。

On the Standardization of Prison Law Enforcement Document---Take Commutation Proposal Documents as an Example

Making a standardized document to draw commutation proposal is one of the practical problems encountered in prisons. Currently, the Criminal Law and Criminal Procedure law have been revised, but commutation proposal document failed to receive timely amendments. Prisons referring to the original provisions make large format differences. Standardized and reasonable commutation proposal should be revised according to newly-revised laws and regulations, combined with the actual needs of the prison and features of commutation proposal procedures.
