公安机关侦查讯问笔录实证研究——以S市X县侦查卷宗为样本

学界在以往的理论探讨中,往往存在人云亦云、主观臆想等情况,因此探讨的问题以及提出的解决对策也时常不切乎实际。为改变这一现状,有必要遵循实证研究的精神,采用实际调研的方法,并以某市某县侦查卷宗为研究样本,从不同讯问场所的讯问时间、次数统计比较以及律师辩护率统计分析等方面,来发现司法实践中存在的问题,并在此基础上作出相应的探讨,以服务于司法实践需要。

Empirical Research on Record of Investigative Interrogation of Public Security Organ---Taking Cases of X county of S City as Example

According to past experiences, academics often repeat others ideas and become full of imaginations in the theoretical discussion. In order to change this situation, it is necessary to follow the spirit of empirical research, use the method of actual research, and through statistics of different interrogation time of interrogation places, comparison of number and a lawyer’s defence rates to find out the problems existing in the judicial practice. Then on the basis of the discussion, a deep probe can be taken and will serve the judicial practice.
