论网络创造效益的方式及其法律问题

知识经济以知识的生产和流通为基础 ,网络的存在提高了知识生产和流通的速度 ,降低了成本 ,通过省略过程或改变过程、代行非创造性劳动以及扩大个体信息量三种方式创造了效益。第一种方式中网络自身的虚拟性、超地域性和即时性引起了一系列法律问题 ,需要对虚拟过程建立规范。第二种方式中原来规范劳动者劳动过程的技术规范变成了控制计算机操作的指令 ,规范计算机工作的是有关软件的产品质量法。第三种方法提出了信息产权问题。

On the Production Manners of Network Benefit and Its Legal Problems

Knowledge economy bases on the production and circulation of knowledge. Network speeds up the production and circulation of knowledge and cuts down its cost. Network gains benefit by three manners: overleap or change process, substitute human in non-creative work and enlarge the laborer's information. In the first manner, network's virtual, over-dominion and instantaneous characteristic brings a series of legal problems, therefore it is necessary to establish new regulations to rectify network. In the second manner, the criterion rectifying the laborer's working process originally has been substituted with instruction controlling the computer's operation regulated by software product quality law. In the third manner, the information property right is brought forward.
