宋代法律体系研究

宋朝前期,沿用唐代的法律体系。神宗元丰时期进行法制改革,采用新的立法模式,形成具有自身特色的法律体系,并于孝宗淳熙时臻于完善。宋代法律体系中各法律形式虽多沿用唐代的名称,但其中不少在编纂体例、部门法属性及效力和适用先后等方面均已发生重大变化。宋代法律体系弥补了唐代法律体系的某些不足,较唐代法律体系更为完善,具有更多的合理因素。

A Study of the Legal System Of the Song Dynasty

In the earlier stage of the Song Dynasty,the old legal system in the Tang Dynasty was adopted.Not until a legal reform was effected in "Yuan Feng's" time during the reign of Emperor Shenzong,was a new legislative pattern set,which yielded a new legal system with its own features.It evolved in "Chun Xi's" time,during the reign of Emperor Xiaozong.Most legal principles and rules in the Song Dynasty assumed the old names used in the Tang Dynasty,but they differed drastically from the old ones in their compilation in laws,categories of branch laws,effect and sequence of application.Having covered the deficiencies in the legal system of the Tang Dynasty,the legal system in the Song Dynasty proved itself more advanced and reasonable.
