STATEWIDE INITIATIVES TO ENCOURAGE ALTERNATIVE DISPUTE RESOLUTION AND ENHANCE COLLABORATIVE APPROACHES TO RESOLVING FAMILY ISSUES

Affiliation:Cynthia Savage, director of the Office of Dispute Resolution for the Colorado Judicial Branch since 1996, is a lawyer, mediator, mediation trainer, and former hearing officer and has been involved with alternative dispute resolution since 1985. Cynthia was director of the Mediation* Arbitration Center and a clinical law professor at the University of Denver College of Law from 1988-1996. Cynthia received her law degree from Harvard Law School in 1981 and her BA in psychology from the University of Michigan in 1975.;Eileen Pruett, program manager, Dispute Resolution Programs Section of Judicial and Court Services Division of the Supreme Court of Ohio, has been with the Court since 1992. She is a lawyer, mediator, and trainer. She has published and given numerous papers and presentations on issues related to alternative dispute resolution. She serves on the Board for the Association of Family and Conciliation Courts (AFCC) and on the Editorial Board for Family Court Review. She is a graduate of The Ohio State University College of Law and Indiana University. She has been involved with dispute resolution programming since 1980.
Abstract:Over the past 27 years, since the concept of the multidoor courthouse was first introduced, methods for resolving family issues have increasingly focused on less adversarial and more collaborative approaches. Infrastructures have developed in a variety of ways in different states to initiate, support, and promote these approaches, and pilot projects have provided an invaluable avenue for testing and implementing changes. This article will describe some of the current statewide initiatives to develop infrastructure and implement change through creative pilot projects and will propose strategies to sustain these changes.
