无身份者能否成为身份犯之共同正犯再探讨

我国《刑法》总则中并无身份的专门规定,刑法理论对身份的理解也没有达成完全共识,当身份与共同犯罪联系起来时显得更为复杂,尤其是对无身份者能否与有身份者成为身份犯之共同正犯问题,更是存在激烈争论。无身份者可以与有身份者构成身份犯之共同犯罪,但由于无身份者的行为对于身份犯而言并不具有实行性,因而无身份者只可以构成身份犯之共犯,不能与有身份者构成身份犯之共同正犯。

Further Discussion on Whether It Is Possible for the Non-status Criminal to Be a Coprincipal of a Status Criminal

Since no special definition of status is made in the General Provisions of Criminal Law of our country and no common understanding of status has been thoroughly achieved in criminal law theory,it becomes even more complicated when status is related to joint crime,and warm argument is still going on especially when it comes to the question whether it's possible for non-status criminal to become a coprincipal with status criminal.It's possible for non-status criminal to commit joint crime with status criminal.However,since the non-status criminal's action is not the act of perpetrating,non-status criminal can not be the coprincipal of the status criminal,but can be the joint criminal only.
