| 摘 要： | 证人作证既是义务,同时也是权利。证人的权利保护问题如果不能妥善予以解决的话,证人不出庭的问题将很难从根本上得到解决。证人的保护分为外源型证人保护与内发型证人保护。外源型证人保护主要是保护证人的权利免受外部力量的威胁与损害;内发型证人保护主要是保护证人不因作证而损害或威胁自己以及其家属的利益。

| Abstract: | The witness is obligated to testify in the court,while on the other hand their rights should also be protected.If the protection of the rights of the witness cannot be properly settled,the problem of the witness' evasion of testify in the court will hardly be eradicated.This dissertation mainly concentrated on the necessity of the protection of the witness,the threats to the rights of the witness,and the analysis of the status quo and the defection of our protection of the witness. |
