论诱惑侦查的相对合理主义

诱惑侦查作为一种特殊的侦查手段,在我国司法实践中一直被广泛地运用,但在立法上对其并无明确的规定,从而导致实或中的混乱及溢用,并引起极大争议。实际上,对这个问题的讨论不能简单化,应在追求相对合理的前提下,一方面使诱惑侦查这种有效的侦查措施继续存在,另一方面针对其可能带来的弊端进行规范,最大限度地降低其负面影响,以实现诱惑侦查应有的价值。

On Relative Rationalism of Tempting Investigation

Tempting investigation,as a special investigative method,has been widely used in judicial practice in our country,but there is no explicit provision on it in the legislation.Therefore,it not only causes the confusion and abuse in practice,but also arouses controversy.In fact,we should keep the tempting investigation on the one hand, keep away the potential pitfalls it may bring on the other hand and reduce the negative influence maximally to realize its value.
