“弱者”之类型：一项法社会学的考察

弱者源于社会的剥夺,使得某些人处于相对的劣势。从类型上看,弱者可以分为心理上的弱者、生理上的弱者、能力上的弱者、机会上的弱者、境遇上的弱者等几大类型。当然,要真正成为法律上的弱者,还必须注重弱者成因的无可避免以及弱者无法用自身的力量予以补足等多种因素,从而使法律上的弱者不致流于空泛。

Types of "the Weak":a Sociological Research of Law

Because of the social deprivation,some people are in bad conditions.The weak can be divided into five types: the weak in psychology,the weak in physiology,the weak in ability,the weak in opportunities and the weak in circumstances.However,when we recognize the weak in law,we must also emphasize the inevitable causes of the weak and the factors that the weak can't complement with their own capabilities so that the images of the weak in law will not be vague and general.
