| 摘 要： | 中国传统行刑文化及行刑制度与儒家传统慎刑思想有着密切的联系，蕴含于其中的合理性因素，如鼓励宽仁治狱；法、理、情相统一的囚犯教育感化制度；录囚制度等。文章旨在通过分析中国传统行刑文化价值核心及其对古代行刑制度的影响，探索其中的合理成分，为当前的行刑制度改革提供历史借鉴。

| Abstract: | Chinese traditionnal execution culture and system of execution have close connection with traditional thought of cautious punishment of confucian School,which contain rational factors among them,such as encourage to show mercy to prisoners;The system of prisoner reform that the law,The principle,the sentiment unifies mutually;The System of interrogating prisoners.The main aim of the essay intend to analye the core of chinese traditionnal Execution Culture and System of Execution and their impacts on system of execution in the ancient times,to probes rational components among them,in order to provide history lessons to current reform of system of execution. |
