中国与英美国家鉴定人制度的比较

所谓鉴定人,是指由公安机关、检察院、人民法院指派或聘请,解决案件中某些专门性问题的具有专门知识和技能的自然人。由于历史渊源、文化背景、社会制度等的不同,导致了英美法系国家和大陆法系国家（包括中国）法律制度的差异。鉴定人制度作为诉讼法律制度的重要组成部分,在两大法系国家的法律规定中,其资格、地位、权利、义务等方面都有所不同。随着世界经济一体化,各国之间政治、经济、文化之间交流与合作将更加密切,为了减少冲突,减少交易成本,批判地吸收和借鉴国外有关鉴定人制度方面的先进经验,完善我国的鉴定人制度已成为必须。本文拟以比较的方法介绍英美国家和中国有关鉴定人的主要法律制度,旨在从比较中能够得到一些启发。

A Comparison of Expert System between Anglo- American Law Countries and China

Expert refers to the natural person who is appointed or engaged by the public security organ,procuratorate or court,has professional knowledge and skills and can resolve special problems of cases. The differences of the historical origins,culture background and the society system lead to the different characters between the countries in Romano - Germanic family, including China and Anglo - American family. As the important part of the system of lawsuit,the expert system has different qualifications,status,righs, liability, etc. Follow the union of world economics and culture.it will be closer at exchanging and cooperating in politics, economics and culture between countries. It is necessary to improve Chinese expert system in order to reduce the conflicts and the prime cost of the trade, critically absord and benefit from the advanced experiences of other countries'expert system.This article drafts the methods of comparison to introduce the chief expert system about the countries in Romano - Germanic famliy and China. The purpose is to get some enlightenment from the comparison.
