| 摘 要： | BOT模式中特许协议的法律制度涉及到特许协议的主体、项目公司的投融资渠道、项目公司的经营权、政府对BOT的支持、特许协议的法律性质等问题。在这些问题上,我国BOT项目实践与现行立法之间存在若干法律冲突,因此,建议制定一部有关BOT的专门法,以促进我国BOT模式的发展。
