对我国四级判例制度之架构

出于对自由裁量的保障与限制考量,我国应当建立四级判例制度。判例制度之建立目的不是为了创制法律,而是为了在法律条文的一般性适用与自由裁量之间植入一个平衡器,避免任意裁量影响一国的法制统一和动摇司法权威,以保障法律的公平适用,真正实现“法律面前人人平等”。为充分发挥判例制度对自由裁量的保障与限制功能,要注重判例的层级设置,遵循一定的适用规则,并严格创制与修改程序。

The Conception of the System of Four-grade Prejudication

The system of four-grade prejudication should be set up in our contry in order to take into account the protection and limitition of free arbitrament.The aim of seting up the system of prejudication is to balance the run-of-mill application and free arbitrament about the law,but not to legislate.It can avoid unification of legal system to be destroied and judicial authority to be fluctuated by free arbitrament.In the same time,it can ensure that the law is fairly applied and every one is equal before the law.We should pay attention to mount different grade prejudication,and abide certain rule of application,and strictly stand by the process of institution and amendment about the law.If we comply these very well,the prejudication can fully exert effect on pretection and limitition of free arbitrament.
