论治安管理中的“没有法律依据”

“没有法律依据”问题是基层公安民警在工作中时常会遇到的一种情况。其表现为：公安民警在进行治安管理或查处治安案件时，因找不到明确、合适的法律条文进行适用而导致工作无法开展。这一方面是由于现行法律在某些方面存在缺欠，另一方面则是由于公安民警自身素质存在某些不足。这一问题所导致的结果，就是无法及时、有效地开展治安管理和进行案件查处，从而无法维护正常的社会秩序和人民群众的利益，必须采取有效措施及时予以解决。

No legal basis in Police Administration

the policemen who work at the grassroots level often encounter a kind of situation the problem of ＂no legal basis＂ in their work. It marked by being unable to unfold their work because they cant find specific and appropriate laws to apply when they perform their duties according to law or investigate and punish public security cases. On the one hand, the present law makes little or no provision in some aspects. On the other hand, polieemen＇s qualities also exists some deficiencies. The result of this problem is that policemen cant unfold supervision and administration for public security and deal with cases promptly and effectively so that they have no way to maintain public order and the interests of people. Therefore, effective measures must be taken to solve this problem timely.
