| 摘 要： | 作为“安全阀”的公共秩序保留制度旨在维护本国的“公共秩序”,它赋予了法官广泛的自由裁量权,为了保证判决公正,需要对其进行适当的限制,即在排除外国法适用后,适用与之有最密切联系的国家的法律来代替。

| Abstract: | To be a safety valve,the duty of reservation of public order system will maintain national public rules.The judges were endowed with the power of discretion.The power should be limited properly to guarantee the fairness.As the foreign laws were expected,the most relative law of one country should be used. |
