The Fast-track Criminal Trial Procedure under the Background of the Transformation of Criminal Litigation Mode

The Fast-track Criminal Trial Procedure is the legal procedure to handle minor criminal cases in which defendants have confessed and accepted punishments.It is an effective approach to construct litigation system of minor crimes.With the legalization and institutionalization of the leniency system for pleading guilty and accepting punishments,Chinese criminal litigation mode is undergoing the process of development and transformation from adversarial to cooperational litigation,from right protection to negotiated consensus orientation,from simplified to diversified structure.Under the background of the transformation of criminal litigation mode,we should convert the litigation concept,get hold of the development direction,and explore pathways to promote the development of the Fast-track procedure.Three dimensions,namely the whole-process diversion of minor cases,the multi-layer arrangements of the procedures,and the systematic construction of relevant mechanism,should be held to further inspire the inner power of the Fast-track procedure,optimize the allocation of judicial recourses and exert its advantages.
