文化权法律保护研究--少数民族地区旅游开发中的文化权保护

文化权的主体是拥有、认同该文化的少数民族全体,主要包括文化自决权和文化使用权.旅游开发存在着忽视少数民族文化权保护的问题,因此法制建设应增强少数民族文化权保护的内容,通过对少数民族地区旅游业的参与观察和调查发现,要由一个明确的执行主体来代表该少数民族行使这些权利,并将行使文化权而实现的物质利益在该少数民族中进行合理分配.

A Study of the Legal Protection of Cultural Right:The Protection of Cultural Right in the Tourism Development in the Minority Areas

The subject of cultural right is the whole ethnic group that possesses and identities itself with the given culture. Cultural right consists of the right to cultural self-determination and the right of using culture. Our tourism developmentoften neglects the protection of the cultural right of the minorities, and so the legal construction should strengthen the related protectionfor them. Through a participant observation in the tourism development of the minority areas, the author concludes that a specific subject should execute this right on behalf of the give minority group and distribute the obtained material interests reasonably among the members of this minority group.
