改革我国拆迁补偿制度的立法建议

为了落实《物权法》关于征地拆迁与不动产物权保护的立法精神,在全国人大常委会的立法授权下,国务院开始了新的拆迁条例的立法工作。而在拆迁立法中,拆迁补偿无疑是被拆迁人关注的焦点,新的立法要拿出让被拆迁人普遍接受的补偿方案,就必须彻底改革现行的补偿制度,改革的内容包括建立城乡统一的拆迁补偿制度、建立房地统一的拆迁补偿制度、建立完全市场化的估价制度、实行拆迁补偿裁决的司法化等。

Legislative Proposal for Reforming Compensation System of Housebreaking in China

Authorised by Standing Committee of the National People's Congress,State Council has begun to draft the new statute of housebreaking to carry out the legislative spirit of land requisition and housebreaking and the protection of real estate in Real Right Law.Compensation system of housebreaking is the focus in the legislation,so it should be reformed thoroughly so as to be widely accepted by the people whose house has been broken.The contents of reform include establishing a uniform compensation system of housebreaking in urban and rural areas,founding a uniform compensation system for both house and land,founding an evaluation system which totally realizes marketization,authorizing the courts to decide the compensation of housebreaking,etc.
