关于完善我国法律服务市场的若干思考

一个完善成熟的法律服务市场应是一个以律师主体全方位参与的统一的、开放的、竞争有序的、规范的市场。而我国目前的法律服务市场仍然处于较混乱状态:非法从事法律服务、不合理的法律准入制度、地方保护主义、律师事务所管理不当等现象严重。因此,我国法律服务市场有待改革:实行律师业务垄断,建立科学、合理、健全的律师制度,完善律师事务所的运行机制,提高律师本身的综合素质,从而促进我国法律服务市场与国际法律服务市场的接轨。

Ideas on the Improvement of the Law Service Markets in China

A perfect and mature law service market should be a unified, open, competitive, orderly and standardized market that allows the all-round participation of the subjects of lawyers. At present, however, the law service markets in China are in chaos of illegal law service, unreasonable law permission system, locale protection and poor management of the lawyer's agencies. Therefore, the law service markets need such reform as introducing the monopolization of lawyer's profession, building scientific, reasonable and healthy lawyer's systems, improving the operating mechanism of lawyer's agencies, and upgrading the lawyer's comprehensive qualities so as to promote the adjustment of China's law service markets in line with the international law service markets.
